Conference “Action collective redress”

In late May 2015, the association Test-Achats announced its intention to introduce a collective action against SNCB, to obtain compensation for travelers prevented from taking their train at the last big strikes of rail. This is the first concrete implementation of the device introduced in the Code of Economic Law by the Law of 28 March 2014 and entered into force on 1 September of the same year.
According to parliamentary work, “collective action enables all consumers who have suffered harm common cause of obtaining compensation for individual damage suffered, and through a representative of the group.”
The aim of this study day is chaired professors Jacques Englebert and Jean-Luc Fagnart, to take stock of this new way of action now open in Belgian law.
