Evidence and regulations eIDAS

Me Thierry Léonard and Me Hervé Jacquemin will remember the principles applicable to the evidence, especially in the digital environment, and will review the innovations introduced by the European regulation on electronic identification and trust services (regulation eIDAS ).
In practice, being able to provide proof of one’s rights is fundamental: disputes may well be lost when one who has the burden of proof has not provided a writing signed.
These rules are also of paramount importance when the procedure is dematerialized (and contract in line). Moreover, we know the importance of the signature in the banking sector and for payment. This conference is intended to recall the rules, while highlighting the many innovations on the subject.
If the case is rare, it is not non-existent, particularly in the event of the scanned signature.
At the legislative level, we must prepare now to eIDAS Regulation of 23 July 2014. It indeed brings many changes to the system of electronic signatures, while also setting other trusted services (electronic timestamp recommended electronics and authentication of websites) and electronic identification.
